In October, the Oklahoma Pardon and Parole Board voted against recommending clemency for the death row inmate.

Fairchild's attorneys argue that he suffers from mental illness and potential brain damage. They claim he was raised amid abuse and substance use and that his brain damage was not brought up at his trial.

A clemency petition said Fairchild can "no longer tell the difference between reality and delusions" due to brain deterioration.
