Oklahoma is days away from executing death row inmate Richard Fairchild.
Fairchild has been on death row since 1993 for killing his girlfriend's 3-year-old son, Adam Broomhall.
In October, the Oklahoma Pardon and Parole Board voted against recommending clemency for the death row inmate.
Fairchild's attorneys argue that he suffers from mental illness and potential brain damage. They claim he was raised amid abuse and substance use and that his brain damage was not brought up at his trial.
A clemency petition said Fairchild can "no longer tell the difference between reality and delusions" due to brain deterioration.
Gov. Kevin Stitt could take action, but he’s never stepped in when there wasn’t a recommendation for clemency.
Fairchild's execution is scheduled for Thursday morning at the Oklahoma State Penitentiary in McAlester.
