For the purposes of these Terms of Service, “Content” also includes all User Content (as defined below).

Storyfa has no obligation to screen, review, monitor, edit or remove any Content, although we reserve the right to screen, monitor or remove any Content in our sole discretion, at any time, with or without any notice to you and for any reason, or for no reason at all. Storyfa is not responsible for, and does not endorse, any Content posted within the Services.

We encourage your feedback, in the form of reviews, suggestions, and comments or recommendations for improvements, modifications or changes to the Services that you may choose in your sole discretion to provide us from time to time (“Feedback”). When you provide Feedback, you grant us, under all right, title and interest in and to the Feedback, a non-exclusive, worldwide, royalty-free, irrevocable, transferable, sub-licensable, perpetual license to use that Feedback for any purpose or to incorporate it into the Services or other products or services.

YOUR USE OF THE SERVICES OR ANY CONTENT ARE AT YOUR SOLE RISK. YOU UNDERSTAND AND AGREE THAT THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" BASIS. WITHOUT LIMITING THE FOREGOING, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE STORYFA ENTITIES DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

The Storyfa Entities make no warranty, conditions or representation that: 1) the Services and Content will be uninterrupted, secure, timely, or error-free, 2) the Services and Content will meet your requirements, 3) the results that may be obtained from use of the Services or Content will be accurate, effective or reliable.

No advice or information, whether oral or written, obtained from Storyfa or through the Services, will create any warranty or representation not expressly made herein.

You are solely responsible for providing, at your own expense, all equipment (e.g., Internet connection, mobile device, computer, etc.) necessary to use the Services, including but not limited to, payment of all fees associated with such access.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORYFA ENTITIES SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOOD-WILL, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF THIRD PARTIES; OR (C) ANY UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

Storyfa allows you to sign up and sign in using your a third party account (i.e. your Google or Facebook account). PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS, AND STORYFA ENTITIES DISCLAIMS ANY LIABILITY FOR PERSONALLY IDENTIFIABLE INFORMATION THAT MAY BE PROVIDED TO IT BY SUCH THIRD-PARTY SERVICE PROVIDERS IN VIOLATION OF THE PRIVACY SETTINGS THAT YOU HAVE SET IN SUCH THIRD-PARTY ACCOUNTS.

5. Indemnification

You agree to indemnify, defend, and hold us and Storyfa Entities harmless from and against any liabilities, claims, losses, damages and expenses, including without limitation, attorney’s fees and costs, that arise from your access to or use or misuse of the Services or Content, including but not limited to your violation of these Terms of Service and/or your violation of any regulations, laws, rules or third party rights, including without limitation, any intellectual property right or privacy right.

6. Changes to the Services, Accessing the Services, Security

We can't guarantee that the Services will be up and running 24/7. We also reserve the right to suspend, eliminate, restrict access to or change the Services or any part of our Services at any time for any reason, with or without any notice. In any case, we will not be liable if for any reason all or any part of the Services is unavailable at any time or for any period, nor for any data loss. We cannot guarantee that all use of the Services will be secure. We cannot guarantee the absolute security of any information. We also do not guarantee that the Services or any Content provided on the Services is error free. You alone are responsible for your password and account security. You must keep your password confidential.

10. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of the Czech Republic without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action or proceeding arising out of, or related to, these Terms of Service or the Services shall be instituted exclusively in the courts of the Czech Republic.

11. General Terms

You may not assign, delegate or otherwise transfer your rights and obligations under these Terms of Service to any party, and any purported attempt to do so will be null and void. We may free assign our rights and obligations under these Terms of Service. Any cause of action brought by you against us or Storyfa Entitites must be instituted with one year after the cause of action arises or be deemed forever waived and barred. These Terms of Service, together with our Privacy Policy constitutes the entire agreement between you and Storyfa and govern your use of the Services, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is determined by a court of competent jurisdiction to be invalid, unenforceable or illegal for any reason, then that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
